Please read this Disclaimer carefully before purchasing or using an Innaide product. It contains important information about what our products are, what they are not, and when they should not be used. This Disclaimer forms part of, and should be read together with, our Terms of Service, Shipping Policy, Pre-Order Terms and Refund, Return & Replacement Policy.

2. What the product is

The Innaide Lift Smart Shorts use Electrical Muscle Stimulation (EMS) to help users train their pelvic floor muscles.

The Innaide Lift Smart Shorts (the "Smart Shorts") are offered as a wellness product. The Product is intended for use by adult women, with new and postpartum mothers as the primary audience.

3. What the product is not

Innaide does not represent, and you should not infer, that the Product diagnoses, treats, cures, prevents or manages any disease, disorder or medical condition.

In particular, we make no claim that the Product treats urinary incontinence, prevents pelvic organ prolapse, cures or diagnoses any medical condition, or guarantees any postpartum recovery outcome.

If you have a health concern, a diagnosed condition, or symptoms that worry you, please consult a qualified healthcare professional. A wellness product is not a substitute for medical assessment or care.

4. No medical advice

Innaide provides usage instructions only.

We do not provide medical advice, diagnosis, treatment recommendations or individualised medical guidance, and we do not provide personalised medical clearance for use of the Product. Nothing on our websites, in our product documentation, in our marketing materials or in any communication from our customer support team is medical advice or a professional assessment of your individual suitability for use.

Only you and your healthcare professional can decide whether the Product is appropriate for you. If you are unsure, consult a qualified healthcare professional before using the Product.

You are responsible for reading and following the usage instructions and safety information supplied with the Product and for observing the precautions set out below.

5. Important EMS safety information

Electrical Muscle Stimulation is not appropriate for everyone. The following is standard safety guidance for EMS use. It is not exhaustive, and it does not replace the instructions supplied with the Product or the advice of a qualified healthcare professional.

5.1 Do not use the Product if you

• are pregnant, may be pregnant, or are trying to conceive
• gave birth less than six weeks ago
• have a cardiac pacemaker, an implantable defibrillator, or any other implanted electronic or metallic device
• have epilepsy or a seizure disorder
• have a heart condition or a heart rhythm disorder
• have a diagnosed or suspected malignancy, or are undergoing cancer treatment
• have deep vein thrombosis, thrombophlebitis or a serious circulatory disorder
• have a fever, an active infection, or an acute inflammatory condition
• have open wounds, broken, irritated or infected skin, an unhealed scar, or a rash in or near the area where the Product is worn
• have reduced or absent skin sensation in the area where the Product is worn
• have pain in the pelvic or abdominal region that has not been assessed by a healthcare professional
• have been advised by a healthcare professional not to use electrical muscle stimulation

5.2 Consult a qualified healthcare professional before using the Product if you

• gave birth more than six weeks ago, including by caesarean section, and have not yet been cleared by your doctor or midwife to begin pelvic floor exercise. Six weeks is a minimum, not a clearance: please speak to your doctor before you start
• have had recent surgery, including pelvic, abdominal or gynaecological surgery
• are receiving treatment or physiotherapy for a pelvic floor, bladder, bowel or gynaecological condition
• have an intrauterine device (IUD), a pelvic implant or surgical mesh
• have diabetes, a nerve condition, a skin condition, or any condition affecting sensation or healing
• have a bleeding disorder or are taking anticoagulant medication
• are using a transdermal patch or applying topical medication in or near the area where the Product is worn
• have any other medical condition, or are taking any medication, that may make EMS inappropriate for you
• are unsure, for any reason, whether the Product is suitable for you

5.3 Do not use the Product

• while driving, cycling, operating machinery, or during any activity in which an involuntary muscle contraction could cause injury
• in the bath or shower, in water, or in a wet environment
• while sleeping
• on any part of the body other than the area the Product is designed for, and never on the head, neck, throat, or across the chest or heart
• at the same time as any other EMS or TENS device, or while connected to high-frequency surgical or monitoring equipment
• if the garment, electrodes, connectors or electronic module appear damaged, worn through or are not functioning normally
• while under the influence of alcohol or any substance that affects your judgement or sensation
• if you are under 18 years of age

For hygiene reasons, the Smart Shorts garment is a personal item and should not be shared with another person.

5.4 Stop using the Product and seek advice if you experience

skin irritation, redness that does not settle, a burning sensation, pain, unusual or persistent discomfort, dizziness or light-headedness, or any other unexpected reaction. If a reaction is severe or does not settle, seek medical attention.

5.5 Follow the instructions

Use the Product only as described in the instructions supplied with it and on our websites, including guidance on session length, intensity, skin preparation, fit, cleaning and care of the garment. Do not modify the Product, its electronics or its electrodes.

6. Individual results vary

Pelvic floor training is affected by many individual factors, including how consistently the Product is used. Experiences and results vary from person to person. We do not promise or guarantee any particular result, outcome or timeframe from use of the Product.

Any statistics, research references or general information about pelvic floor health published on our websites or in our marketing materials are provided for general information only. They are not claims about the performance of the Product for you, and they are not a substitute for professional advice.

7. Website content

Content on innaide.in and innaide.com is provided for general information only. We take reasonable care to keep it accurate and current, but we do not warrant that it is complete, accurate or up to date at all times. Our websites may link to third-party websites, which we do not control and for whose content we are not responsible.

8. Data we collect

We collect and store customer account information, customer contact information, and payment information only to the extent necessary for refunds and payment processing. We do not collect or store device usage data, workout or session data, pelvic-floor performance data, health data, EMS performance data or device telemetry. We do not currently use cookies, analytics or advertising pixels for analytics or marketing. See our Terms of Service and our Privacy Policy for further detail.

9. Liability

Subject to Section 10 and to the extent permitted by applicable law, Innaide is not liable for loss, injury or damage arising from use of the Product that is contrary to the instructions or safety information we provide, from use of the Product where a contraindication described in Section 5 applies to you, or from a decision to use the Product without seeking professional advice where this Disclaimer recommends that you do so.

10. Your statutory rights

Nothing in this Disclaimer is intended to exclude, restrict or limit any right or remedy available to you under the Consumer Protection Act, 2019, the rules made under it, or any other applicable Indian law that cannot lawfully be excluded, restricted or limited, including in relation to defective goods and product liability. Nothing in this Disclaimer excludes or limits liability for death or personal injury caused by our negligence, or for fraud. Where any provision of this Disclaimer conflicts with such a right, that right prevails.

11. Changes to this Disclaimer

We may update this Disclaimer from time to time, including to reflect changes to the Product or to our safety guidance. Updated versions will be posted on innaide.in and innaide.com and will be shared by email with users who have purchased a Product from us. Updated terms will not be applied to a user whose relevant order or pre-order has already been refunded. Nothing in this section operates to exclude any obligation imposed on us by applicable Indian law.

12. Governing law and jurisdiction

This Disclaimer is governed by the laws of India. Subject to Section 10 and to any mandatory statutory forum available to you as a consumer, the courts at Delhi shall have jurisdiction.
